- Disclosure Regarding Real Estate Agency Relationships

- This is to clarify whose side the agent works for. If your agent worked for the same real estate company that had the listing than your agent would be legally required to disclose everything about you to the seller. This document must be read and acknowledged before reviewing a purchase contract.

- Buyer Broker Agreement

- This is the contract used to purchase 5 or more units(Multi Family) or other income type properties and was substantially revised in October 2002. It is a 10 page document which outlines the price and terms of the contract between the buyer and the seller. It covers all the buyer and seller obligations and disclosures requirements relating to purchasing an income property.

- Purchase Agreement Addendum

- This is what you use when you are ready to write an offer to purchase a property and is used for a single-family homes and 1-4 units. It is a 10 page legal document which has major updates every 2 years so unless you have bought a property in the last 2 years this contract may have changed and should be further reviewed.

- Counter Offer

- Once the offer is written the seller will either accept the offer, counter it with this form or not counter. If they do counter they may check the box that says this is a multiple counter offer which means that they are countering to us and at least one other buyer. There is no limit to the number of counters that can go back and forth before the price and terms are agreed upon.

- Real Estate Transfer Disclosure Statement

- This is probably one of the most important documents the seller will give you as in it the seller must disclose any known material fact with the home that they are aware of i.e. if there are any neighboring noise issues, defects in the home, anything done without permit or not to code, lawsuits or violations on the home, etc.

- Request For Repair

- This forms is used after the offer is accepted and the buyer has found things that had not been disclosed prior to writing an offer and the buyer would either like the seller to fix them or get a credit back. Usually this form needs to be returned to the seller within 14 days after the acceptance of the offer.

- This just gives notice to the other party that they need to comply with something that was agreed to in the contract. For example, if the buyer was supposed to sign off the loan contingency or the physical inspection within 17 days of the acceptance of the offer and has not, they can send the buyer a Notice for Buyer to Perform. The buyer then has 1-3 days depending on what was agreed to in the contract to comply.

- Verification of Property Condition

- This form is a "final walk through" of the property to make sure the property is in substantially the same condition as of the date of acceptance of the offer and that any repairs the seller was suppose to do have done have been done. It usually takes place within 5 days prior to the close of escrow and preferably once the seller has moved their personal property out of the property in order to fully view the property.
